TWO YEAR LIMITED WARRANTY FOR EV CHARGING STATIONS

I. COVERAGE

Subject to the Exclusions listed herein, Dunamis Charge, Inc. expressly warrants to the original purchaser (“Customer”) of the Dunamis Charge, Inc. EV Charging Station (“Product”) that the Product will be free from defects in design, materials, manufacture and workmanship when used under normal circumstances and for the purpose for which it was intended.

II. TERM

This Warranty shall commence from the date of purchase and will continue for a period of two (2) years. (“Warranty Period”). This Limited Warranty is non-transferable and applies only to the original purchaser of the Product.

III. EXCLUSIONS

This Limited Warranty does not cover any Product that has been:

  • Used for purposes other than those for which it was designed.
  • Repaired or altered by anyone other than Dunamis Charge, Inc., or its authorized service providers.
  • Damaged because of transportation, storage, mishandling, abuse, neglect, accident, or any other cause beyond the reasonable control of Dunamis Charge, Inc.
  • Damaged by failure to comply with applicable installation, operating or maintenance instructions or guidelines provided by Dunamis Charge, Inc.
  • Used in conjunction with any product, accessory or software not expressly approved by Dunamis Charge, Inc.
  • Tampered with, including but not limited to, removing, altering or defacing the Product’s original serial number

IV. REMEDIES

If the Product becomes defective within the Warranty Period, Dunamis Charge, Inc. will, at its sole discretion, either repair, replace the Product. This warranty does not include any on-site labor costs related to un-installing or reinstalling the repaired or replacement Product.

V. CLAIM PROCEDURE

To make a claim under this Limited Warranty, contact Dunamis Charge, Inc. at support@dunamischarge.com and provide proof of purchase, a description of the problem, and any other information reasonably requested by Dunamis Charge, Inc. If Dunamis Charge, Inc. determines that the Product is eligible for warranty coverage, Dunamis Charge, Inc. will provide further instructions on how to return the Product.

VI. LIMITATIONS ON WARRANTY

This express limited warranty is the sole warranty provided by Dunamis Charge, Inc. with respect to the Product. To the fullest extent permitted by law, Dunamis Charge, Inc. disclaims all other warranties, whether express or implied, including but not limited to the implied warranty of merchantability and the implied warranty of fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow exclusions of an implied warranty, or non-infringement. Some jurisdictions do not allow exclusions of an implied warranty, so the above limitation or exclusion may not apply to you. Please review the laws in your jurisdiction to understand your rights fully.

VII. EXCLUSIVE AGREEMENT

This warranty is the entire and exclusive remedy of the Customer with respect to the Product. Dunamis Charge, Inc. may, in its sole discretion, modify the terms and Conditions of this limited warranty from time to time by providing written notice to the customer or by posting the revised terms and conditions on the Dunamis Charge, Inc. Website.


VIII. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Dunamis Charge, Inc. shall not be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the product, including, without limitation, damages for loss of use, loss of profits, business interruption, or any other commercial damages or losses, even if advised of the possibility thereof. In no event shall Dunamis Charge, Inc.’s liability for direct damages arising out of or in connection with the product exceed the purchase price of the product. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Please review the laws in your jurisdiction to understand your rights fully.


IX. GOVERNING LAW AND JURISDICTION

This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to any principles of conflicts of law. The Customer agrees​ to submit to the exclusive jurisdiction of the state and federal courts located in Michigan for the​ resolution of any disputes arising under this Limited Warranty.​


X. SEVERABILITY

If any provision of this Limited Warranty is held to be invalid or unenforceable, the remaining​ provisions shall remain in full force and effect.

Our EV charging stations are designed and built to Best-in-Class reliability standards for achieving exceptional operational uptime. While we feel issues with our chargers are unlikely, we want our customers to know and be assured we will stand by our commitment to provide a properly working charger unit.

To ensure our customers have the support they need if any issues arise after the 2-year warranty has expired, we are pleased to offer an extended warranty plan that covers potential issues and provides peace of mind for up to five years. This extended warranty plan builds on the original manufacturer’s warranty, offering additional protection and support.
