I.  Warranty Coverage
Dunamis Charge warrants to the original purchaser (“Customer”) of the Dunamis Charge Level 2 EV Charging Station (“Product”) that the Product will be free from defects in materials and workmanship under normal use and service for a period of two (2) years from the date of purchase (“Warranty Period”). This Limited Warranty is non-transferable and applies only to the original purchaser of the Product.

II.  Warranty Exclusions
This Limited Warranty does not cover any Product that has been:

1. Used for purposes other than those for which it was designed;
2. Repaired or altered by anyone other than Dunamis Charge or its authorized service providers;
3. Damaged as a result of transportation, storage, mishandling, abuse, neglect, accident, or any other cause beyond the reasonable control of Dunamis Charge;
4. Damaged by failure to comply with applicable installation, operating or maintenance instructions or guidelines provided by Dunamis Charge; or
5. Used in conjunction with any product, accessory or software not expressly approved by Dunamis Charge.
   Dunamis Charge reserves the right to refuse warranty service if the Product has been tampered with or if the Product’s original serial number has been removed, defaced or altered. This Limited Warranty does not cover any costs associated with the removal, installation or reinstallation of the Product.

III.  Warranty Remedies

If Dunamis Charge confirms the existence of a defect that is covered by this Limited Warranty during the Warranty Period, Dunamis Charge will, at its sole discretion, either repair or replace the Product or provide a refund of the purchase price.

IV.  Warranty Claim Procedure

To make a claim under this Limited Warranty, the Customer must contact Dunamis Charge at [email protected] and provide proof of purchase, a description of the problem, and any other information reasonably requested by Dunamis Charge. If Dunamis Charge determines that the Product is eligible for warranty coverage, Dunamis Charge will provide the Customer with further instructions on how to return the Product.

V.  Disclaimer of Warranties

THIS EXPRESS LIMITED WARRANTY IS THE SOLE WARRANTY PROVIDED BY DUNAMIS CHARGE WITH RESPECT TO THE PRODUCT. TO THE FULLEST EXTENT PERMITTED BY LAW, DUNAMIS CHARGE DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. PLEASE REVIEW THE LAWS IN YOUR JURISDICTION TO UNDERSTAND YOUR RIGHTS FULLY.

VI.  Sole and Exclusive Warranty

THE FOREGOING WARRANTY CONSTITUTES DUNAMIS CHARGE’S EXCLUSIVE LIABILITY, AND THE SOLE AND EXCLUSIVE REMEDY OF THE CUSTOMER, FOR ANY BREACH OF ANY WARRANTY OR OTHER NONCOMFORMITY OF THE PRODUCT. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES. DUNAMIS CHARGE MAY, IN ITS SOLE DISCRETION, MODIFY THE TERMS AND CONDITIONS OF THIS LIMITED WARRANTY FROM TIME TO TIME BY PROVIDING WRITTEN NOTICE TO THE CUSTOMER OR BY POSTING THE REVISED TERMS AND CONDITIONS ON THE DUNAMIS CHARGE WEBSITE.

VII.  Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DUNAMIS CHARGE SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF. IN NO EVENT SHALL DUNAMIS CHARGE’S LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PRODUCT EXCEED THE PURCHASE PRICE OF THE PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. PLEASE REVIEW THE LAWS IN YOUR JURISDICTION TO UNDERSTAND YOUR RIGHTS FULLY.

VIII.  Governing Law and Jurisdiction

This Limited Warranty shall be governed by and construed in accordance with the laws of the State of Michigan, without giving effect to any principles of conflicts of law. The Customer agrees to submit to the exclusive jurisdiction of the state and federal courts located in Michigan for the resolution of any disputes arising under this Limited Warranty.

IX.  Severability

If any provision of this Limited Warranty is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.wo
